Die Verwertungsgesellschaft GEMA hat im Streit mit dem Videoportal YouTube trotz laufender Gespräche Berufung gegen das Urteil der ersten Instanz eingelegt.
Das Landgericht Hamburg hatte im April entschieden, dass YouTube einige urheberrechtlich geschützte Inhalte löschen und darüber hinaus Maßnahmen ergreifen muss, um den Upload geschützter Werke zu erschweren.

Eine grundsätzliche Täterhaftung für derartige Rechtsverstöße wollte das Gericht aber nicht erkennen, auch muss der Portalbetreiber nicht jeden einzelnen Upload prüfen.

Nach dem Urteil hatten die Streitparteien mit Verhandlungen über die Lizenzierung von YouTube-Videos mit lizenzpflichtiger Musik begonnen. Bis zum Ablauf der Berufungsfrist habe keine Einigung erzielt werden können, teilte die GEMA am Montag mit. Die Verwertungsgesellschaft müsse die Rechte ihrer Mitglieder wahren. "Wir wollen uns verständigen", sagte GEMA-Anwalt Alexander Wolf der Nachrichtenagentur dpa. "Wir müssen aber auch darauf achten, dass die Rechtspositionen unserer Mitglieder gewahrt bleiben."

Darüber hinaus sind sich die Verhandlungspartner offenbar nicht einig, ob ein mögliches Ergebnis veröffentlicht werden soll. Die GEMA steht auf dem Standpunkt, dass sie rechtlich zur Veröffentlichung verpflichtet ist. "Das Transparenzgebot ist für uns von entscheidender Bedeutung", erklärte GEMA-Vorstandschef Harald Heker. YouTube ist nach Angaben der Verwertungsgesellschaft dagegen derzeit nicht bereit, die Ergebnisse der Verhandlungen offenzulegen.

Da der Streit eine grundlegende Bedeutung hat, wurde erwartet, dass beide Parteien an einer letztinstanzlichen Klärung des Konfliktes interessiert sind. Nach Einschätzung von Experten werden nun sechs bis zwölf Monate verstreichen, bis der Fall nun in der nächsten Instanz vor dem Oberlandesgericht in Hamburg neu verhandelt werden kann.
